Terms & Conditions
Last updated: September 12, 2026
These Terms & Conditions ("Terms") govern your access to and use of PharmaITCS — the pharmacy management platform provided as a hosted cloud application and as a downloadable Windows desktop application (together, the "Service") — including the trial sign-up form and any software you download from this website. By checking the agreement box on our sign-up or download form, creating an account, or installing the desktop application, you agree to these Terms. If you are agreeing on behalf of a pharmacy or other business, you confirm you have the authority to do so, and "you" refers to that business.
1. The Service
PharmaITCS provides point-of-sale, inventory, purchasing, accounting, prescription record-keeping, and online storefront tools for pharmacies, in two forms:
- The cloud application — accessed through a browser, hosted centrally, and offered on a subscription plan after an initial free trial period.
- The desktop application — a Windows program you download and install, which runs on your own computer(s) and is offered on a free trial followed by a paid license.
We may add, change, or remove features of the Service over time, and may offer different plans or license tiers than described on this website at any given time.
2. Trials, Subscriptions & Licenses
- A new pharmacy account on the cloud application, and a new installation of the desktop application, each begin with a free trial period (currently 7 days), after which continued use requires an active paid subscription plan (cloud) or a license key (desktop).
- Subscription plans (cloud) are billed on a recurring basis until cancelled. Desktop license keys are billed annually and include a grace period after expiry, as communicated to you at the time of purchase.
- You are responsible for choosing a plan or license tier appropriate to your pharmacy's size and needs, and for keeping your billing and contact details current.
- We may change our pricing or plan structure with reasonable advance notice. Continuing to use the Service after a pricing change takes effect means you accept the new pricing.
3. Your Account & Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials, staff logins, and any license keys issued to you, and for all activity that occurs under them.
- You are responsible for the accuracy of the data you enter into the Service — including medicine records, prices, tax settings, and prescription records — and for complying with all laws and professional/regulatory obligations that apply to operating a pharmacy in your jurisdiction.
- You agree not to misuse the Service: no attempting to bypass licensing or security controls, reverse-engineer the software beyond what applicable law permits, resell or sublicense the Service without our written consent, or use the Service to store or process content that is unlawful, infringing, or fraudulent.
4. Your Data
You own the business data you put into PharmaITCS — your medicines, prices, stock, sales, customers, and prescription records. We do not sell your data, and we do not share it with other pharmacies or unrelated third parties. Our Privacy Policy explains what we collect, how it is used, and which service providers (such as our hosting and database provider) process it on our behalf.
On the desktop application, your business data is stored on your own computer (or your own local network) by default, and is not sent to us unless you explicitly enable an optional online feature that requires it.
You are responsible for keeping your own backups where the Service provides backup tools (for example, the desktop application's local backup feature), in addition to any backups we may maintain.
5. Intellectual Property
PharmaITCS, its software, branding, and documentation are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your own pharmacy business for as long as your subscription or license remains active. Nothing in these Terms transfers ownership of the software to you.
6. AI Features
Where AI-assisted features are enabled on your account (such as invoice or prescription reading, or the AI Assistant's summaries), they are provided as a convenience to speed up manual tasks and narrate figures that are otherwise calculated directly from your own data. AI output is not a substitute for professional pharmacist judgment, does not constitute medical advice, and should be reviewed by a qualified staff member before being relied upon — this is particularly important for anything touching prescription or dosage information.
7. Third-Party Services
The Service relies on third-party infrastructure providers to operate — including database and authentication hosting, cloud hosting, and transactional email delivery — and, where you enable AI features, an AI provider. These providers process data strictly to deliver the Service to you, as described in our Privacy Policy. We are not responsible for outages or issues caused solely by a third-party provider's own service, though we will make reasonable efforts to work around them.
8. Downloads & Installation
By downloading and installing the PharmaITCS desktop application, you agree to install it only on computers you own or are authorized to install software on, and you accept that, like any installed software, it will run with the permissions normally granted to desktop applications on your operating system. We make reasonable efforts to keep installers free of malware, but you should always download the desktop application only from this website or another source we explicitly point you to.
9. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that every feature (including AI-assisted features) will always be available.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the claim arose.
10. Termination
You may cancel your subscription or stop using the desktop application at any time. We may suspend or terminate access to the Service if you breach these Terms, fail to pay applicable fees, or use the Service in a way that risks harm to us, other users, or third parties. On termination, your right to use the Service ends, though provisions of these Terms that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
11. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above when we do, and for material changes we will make reasonable efforts to notify you (for example, by email or an in-app notice). Continuing to use the Service after a change takes effect means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of Pakistan, without regard to its conflict of law principles, unless a different governing law is agreed with you in writing (for example, in a signed enterprise agreement).
13. Contact
Questions about these Terms can be sent to [email protected].
